Our company as well as our website is not related to: Entrepreneur Media, Entrepreneur Magazine, Entrepreneur of the Year, Entrepreneur's Partner, Hispanic Entrepreneur, Entrepreneur.com, Entrepreneurs.com Entrepreneur's Only, The Entrepreneur's Source, Entrepreneur's Notebook, young entrepreneur or any of the many companies that use the word entrepreneur in their trade name.
We have no affiliation with Entrepreneur Media, Entrepreneur Magazine, Entrepreneur of the Year, Entrepreneur's Partner, Hispanic Entrepreneur, Entrepreneur.com, Entrepreneurs.com Entrepreneur's Only, The Entrepreneur's Source, Entrepreneur's Notebook, young entrepreneur or any of the many companies that use the word entrepreneur in their trade name. Our company is “The Motivated Entrepreneur”, and we are a business incubation firm.
We are members of the F.B.I.A Florida Business Incubation Association, and Entrepreneur Media, Entrepreneur Magazine, Entrepreneur of the Year, Entrepreneur's Partner, Hispanic Entrepreneur, Entrepreneur.com, Entrepreneurs.com Entrepreneur's Only, The Entrepreneur's Source, Entrepreneur's Notebook, young entrepreneur do not claim to be business incubators, nor are they current members of any business incubation association as of June 22, 2005, which we are already members of.
In recent court cases companies have made the claim that anyone who places a disclaimer on their site is admitting to improper usage of a trademark, we directly disagree and make mention once again in a declaratory statement that our mark has no association or intention of being associated with Entrepreneur Media, Entrepreneur Magazine, Entrepreneur of the Year, Entrepreneur's Partner, Hispanic Entrepreneur, Entrepreneur.com, Entrepreneurs.com Entrepreneur's Only, The Entrepreneur's Source, Entrepreneur's Notebook, young entrepreneur or any of the many companies that use the word entrepreneur in their trade name or any of their subsidiaries, and we directly disagree with anyone’s stance that placing a disclaimer is admitting guilt.
This is a declaratory statement as well as a disclaimer stating that our business name, logo and pending trademark has no affiliation with Entrepreneur Media, Entrepreneur Magazine, Entrepreneur of the Year, Entrepreneur's Partner, Hispanic Entrepreneur, Entrepreneur.com, Entrepreneurs.com Entrepreneur's Only, The Entrepreneur's Source, Entrepreneur's Notebook, young entrepreneur or any of the many companies that use the word entrepreneur in their trade name.
This disclaimer has been placed on this site to inform Entrepreneur Media, Entrepreneur Magazine, Entrepreneur of the Year, Entrepreneur's Partner, Hispanic Entrepreneur, Entrepreneur.com, Entrepreneurs.com Entrepreneur's Only, The Entrepreneur's Source, Entrepreneur's Notebook, young entrepreneur or any of the many companies that use the word entrepreneur in their trade name or any of the above mentioned subsidiaries to notify and inform anyone who is concerned or may take interest.
The term “Entrepreneur” is commonly used to identify information materials of interest to small business owners. The 1999-2000 editions of Books in Print lists approximately 250 titles that from a number of publishers beginning with the word “Entrepreneur”, “Entrepreneurial”, or “Entrepreneurship”.
We make reference to this because it is our belief that based on court ruling 201 of the Federal Rules of Evidence, the court may take judicial notice of matters that are indisputable because they are capable of immediate and accurate verification through reliable sources.
The terms “entrepreneur”, “entrepreneurial” and “entrepreneurship” are commonly used in official proclamations, statutes, and government programs to refer to small business owners. As the second circuit stated (299 F.2d 33,36 (2d Cir. 1962)), the registering of a proper noun as a trademark does not withdraw it from the language, nor reduce it to the exclusive possession of the registrant which may be jealousy guarding against any and all other use by others.
With such broad usage of the word “entrepreneur”, “entrepreneurial”, and “entrepreneurship”, our use of the term “Motivated Entrepreneur” or “The Motivated Entrepreneur” cannot create confusion in the minds of small, medium, or large business owners as to the source of these materials. |
